Between Bedford Street Lock 2 and Planet Lock 3

 

Thursday 11 November 2010 until further notice BW has had to stop navigation and remove the water from the canal between Bedford Street Lock 2 and Planet Lock 3 due to the collapse of the towpath and canal wall over a 10 metre length. This section of canal is adjacent to a private development and BW is currently investigating the failure and is working closely with the developer's contractor. The navigation and towpath will remain closed until further notice.

 

The pound between lock 2 and 3 has been dewatered

 

British Waterways apologise for any inconvenience this may cause.

 

The towpath is also closed

Thursday 11 November 2010 until further notice UPDATE (12 November 2010): Following investigations into yesterday’s closure of the canal between Lock 2 and Lock 3; it would appear that a third party retaining wall, along with a section of towpath over a 10 metre length has collapsed into the development site. Our engineers and the developers are working closely to find a solution.

 

More updates will follow when information is available.

 

Craft may wind at the bottom of Bedford Street Locks and down stream of Bridge 8, Lichfield Street.

Thursday 11 November 2010 until further notice UPDATE (12 November 2010): Following investigations into yesterday’s closure of the canal between Lock 2 and Lock 3; it would appear that a third party retaining wall, along with a section of towpath over a 10 metre length has collapsed into the development site. Our engineers and the developers are working closely to find a solution.

 

More updates will follow when information is available.

 

Craft may wind at the bottom of Bedford Street Locks and down stream of Bridge 8, Lichfield Street.

How close was that to a breach?

 

That may well take a little time to resolve - lucky it is not July!

 

We are stuck on it...what a nightmare, no diesel, couldnt turn around, yesterday we had to catch 2 trains to fetch our car so we could go get diesel, and then had to reverse the boat 2 miles in the rain, oh what fun..we have booked a winter mooring at audlem and cant get there, if we arent off the caldon by 4th jan (stoppages) we will be stuck here all winter..

Vent your frustration (Don't Get Mad, Get Even).

Record your costs, like the train fare, extra car mileage required at the 40p per mile rate the taxman recognises, etc.

Write a stiff letter of complaint to the Site Manager pointing out you hold them responsible for showing a lack of duty of care. Deliver this in person, or send recorded delivery, and add the costs to your claim.

Point out that you will be putting in a weekly claim to them to recover your additional costs.

Point out that these costs may continue after the wall is repaired, and the canal rewatered, if you are caught by the stoppages already notified by BW.

Point out that you will make claims via the Small Claims Court if restitution is not agreed in principle within 2 weeks (specify the date).

Get the paperwork from the SCC and start filling it in while you are angry.

Strictly, they may not let you make interim claims, as the court may see this as a way of circumventing their rule about Maximum claim size, but go ahead anyway and be prepared to make two claims on different grounds. One for the inconvenience while the canal is de-watered, and a second for the inconvenience while you are caught by the BW blockages that the dewatering caused you to suffer.

 

There are two justifications for this action.

1/ It may get you some money.

2/ The prospect of the additional costs, and the actuality of having to deal with the paperwork, will concentrate the minds of the building firm to get the problem sorted quickly, which is what you and everyone else really wants.

You are dealing with professionals (or shall we say people very experienced with complainants). Be polite and they will brush you off easier than a fly from a sandwich. In which case why did you bother? If (IF) you are going to invest time and energy, make it an effective investment.

The alternative is to adopt the 'life's too short' approach and just mould yourself round the rocks life puts in your path. There are different people happily surviving by following either path, it's the middle path that seems so wasteful - moaning, whingeing, but not taking effective action.

 

Good Luck, and choose what suits you, not what some armchair 'expert' feels is best :-)

Thursday 11 November 2010 until further notice UPDATE (21 December 2010): Due to the continued inclement weather the planned works to the third party wall have been delayed. Discussions continue with the Developer along with British Waterways with the aim to reopening navigation by the 10th January 2011 subject to no further delays.

 

British Waterways apologise for any incovenience caused.

Stoppage history:

UPDATE (22 November 2010): BW are pleased to advise that works to the third party wall are now underway.

The developers anticipate these works will be completed within three weeks; further updates will be issued in due course. British Waterways apologise for any inconvenience this may cause.

Update ...

 

Between Bedford Street Lock 2 and Planet Lock 3

 

Thursday 11 November 2010 until further notice UPDATE (05 January 2011): Works to the third party wall are in their final stages of completion. British Waterways will re-fill the canal on Thursday 6th January and anticipate to be fully open to navigation by the 10th January subject to stillage test. The towpath is anticipated to reopen on the 17th January.
